It is an honour to be published in the Medical Republic on this important issue.

Last night's federal budget had a clear one-line message for GPs: it rewards practice owners and part-owners running active businesses, and it punishes passive investors and salaried workers.
If you own or part-own a practice, distribute through a family trust, run a bucket company, hold investment property, or are planning to sell your practice in the next decade, this budget was about you.

Four structural changes to plan around:
30% minimum tax on discretionary trusts from 1 July 2028
50% CGT discount replaced with indexation plus a 30% floor from 1 July 2027
Negative gearing limited to new builds for established housing acquired after budget night
Bucket companies reset from 1 July 2028
Nothing is legislated yet and the substantive changes do not commence until 1 July 2027 at the earliest. That gives a 13-month planning window. Rollover relief is available from 1 July 2027 to 30 June 2030 to restructure discretionary trusts with no federal income tax or CGT consequences. Stamp duty on business assets is nominal in most states.

This is not the moment to assume family trusts are dead. They remain the strongest available shield for asset protection, family law exposure, and creditor risk. The income-splitting amplifier has been turned down. The structure itself has not lost its purpose.
For working GPs, becoming a practice owner or part-owner is in many cases the strongest single response to this budget.

Uber court ruling exposes GPs to massive tax bills, bulk-billing at risk
I was honoured to be interviewed in today national Australian news paper as a specialist medical accountant on the critical issue of compliance for medical practices and how to legally avoid paying payroll tax by ensuring your properly classifying your business.
I urged practice managers to always double-check their compliance positions:

“They need to really get a second opinion because they could be falsely misclassifying themselves … and they could find themselves paying all this payroll tax and back taxes,” he said.
“It really is putting the medical and healthcare industry on notice that they need to look in their own back garden, because what the judges are saying is if you look like a duck and sound like a duck, and the evidence shows that, you’re going to be eligible for payroll tax.
“You’re opening yourselves up for a bit of a fight with the tax man that is avoidable purely due to a misunderstanding, which clearly a lot of lawyers and accountants in Australia have not been clear on themselves.”
With record numbers of GPs set to retire in the coming years, Mr Dahm said increasingly onerous tax obligations would push young doctors away from setting up their own clinics.
“We need to build structural capability and a succession plan for the next generation of doctors, and it’s not being handled properly now. If people think this is a cacophony of tax laws that are so complicated that they can’t be solved, then we’ve got a real problem,” he said.“
